The European Committee on Crime Problems (CDPC) gathered on 3-4 November 2020 for its 78 th plenary meeting via teleconference. The CDPC decided to examine the feasibility Study of a future Council of Europe instrument on Artificial Intelligence (AI) and criminal law prepared by the Working Group, composed of representatives of member states of the Council of Europe and supported by scientific experts. The CDPC also agreed to set up a Working Group to draft an instrument on AI and criminal law. It was suggested that this instrument should focus specifically on vehicles and automated driving. It was agreed that the mandate of the Working Group will be drafted by the Bureau in order to be submitted for final approval by the Committee of Ministers. Progress regarding the Council for Penological Co-operation continues, with the CDPC noting the ongoing work on the use of new technologies and AI by prison and probation services. The draft Recommendation on the assessment, management and reintegration of persons accused or convicted of a sexual offence will be examined in view of its approval at one of its plenary meetings in 2021. Following the discussions on the working paper on ‘Protecting the Environment through Criminal Law’, the CDPC decided to set up a Working Group to discuss the possible steps moving forward.
