Spina, acting as Agents,defendant, 1 By its action under Article 263 TFEU, the applicant, Novartis Europharm Ltd, seeks the annulment of the Commission Implementing decision C(2024) 6053 final of 22 August 2024 granting marketing authorisation, under Regulation (EC) No 726/2004 of the European Parliament and the Council, for “Nilotinib Accord – nilotinib”, a medicinal product for human use.2 By letter lodged at the Court Registry on 26 March 2025, the applicant informed the Court in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings and requested that the General Court should decide on the costs pursuant to Articles 136 and 138 of these rules.3 By letter lodged at the Court Registry on 2 April 2025, the defendant informed the Court that it had no observations to make in relation to the discontinuance and that the applicant should bear the costs, in accordance with Article 136(1) of the Rules of Procedure.4 Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the...
