INT/1077 Internal Market Information System/Posting of workers Point 2.2 Amend as follows: Draft opinion Amendment The EESC stresses that European businesses, especially micro, small and medium-sized enterprises (SMEs), face unfair competition due to other parties’ circumvention of posting rules and fraud. Reason The EESC is aware that European businesses, especially micro, small and medium-sized enterprises (SMEs), can in some circumstances face unfair competition due to other parties’ circumvention of posting rules and fraud. These risks have already been significantly reduced by Directive 2014/67/EU. The objective of the draft Regulation is to reduce administrative burden for businesses and national competent authorities by facilitating on the one hand the submission of posting declarations where required, in a user-friendly way, at a distance and by electronic means, and on the other hand the administrative cooperation between Member States as well as the effective monitoring of compliance with the obligation set out in Directives 2014/67/EU and 96/71/EC. The proposal will make it easier for Member States to carry out effective and adequate inspections on their territory, contributing to the protection of posted workers. Alleged fraud is not conducted by submitting a posting declaration, rather by breaching applicable rules.
