European Parliament 2019-2024 Committee on Petitions 3.3.2022 NOTICE TO MEMBERS Subject: Petition No 0634/2021 by Isaac Ibáñez García (Spanish) on the European Central Bank’s compliance with the German Constitutional Court’s judgment of 5 May 2020 regarding the public sector purchase programme (PSPP) 1. Summary of petition The petitioner calls on the European Parliament to investigate whether the European Central Bank has, since the judgment of the German Constitutional Court of 5 May 2020, complied with the requirements set out in that judgment, as stated by the German Court in its Resolution of 29 April 2021. The petitioner points out that, in accordance with the established case-law of the Court of Justice of the European Union, the Treaties and the corresponding laws adopted by the EU have primacy over the laws of the Member States. In its judgment of 5 May, the German court declared that both the European Central Bank and the Court of Justice of the European Union had acted outside their powers: the former with the public sector purchase programme (PSPP), and the latter by stating in its 2018 Weiss judgment that the PSPP complied with EU law. The petitioner notes that, in a press release of 18 May 2020, the German Constitutional Court clarified that the European Central Bank had complied with its judgment.
