Energy Traders Europe comments on the Methane Emissions Regulation Importer Obligations The EU Methane Emissions Regulation1 (MER) has been introduced to accelerate reductions in methane emissions, in part encouraged by increased reporting and other obligations placed on importers. Nevertheless, the lack of clarity in the legislative text is giving concern to market parties in how to demonstrate compliance within current and future commercial contracting arrangements. This is already affecting deals being concluded, whose terms stretch beyond introduction of the new requirements. Implementing and Delegated Acts and other guidance, as provided for in the Regulation, are needed as a matter of priority to provide the necessary certainty. Key messages • MER contains provisions for penalties without providing sufficient clarity on some of the obligations and how firms can demonstrate compliance. • Information reporting does not take account of the commoditised nature of the product where gas has been traded at virtual hubs or commingled or swapped in transportation between shippers or within a shipper's own portfolio, such that the traceability of gas in many cases is impossible. • Until clarity is provided and workable arrangements can be put in place, EU risks to constrain supply availability, and undermine energy security.
