Hieber, lawyer)Defendant: European Commission Form of order sought The applicant claims that the Court should:establish that, by failing to adopt a communication including a new time line for the adoption of a legislative proposal in response to the European citizens’ initiative “End the Cage Age” amending the Commission’s Communication on the European Citizens’ Initiative “End the Cage Age”, C(2021)4747 final, of 30 June 2021, the European Commission infringed the Treaties;annul the Commission’s rejection resulting from Commissioner Kyriakides’ letter dated 5 February 2024 of the applicant’s request for access to the file in the “End the Cage Age” matter;order the Commission to pay the costs. Pleas in law and main arguments In support of the action, the applicant relies on two pleas in law. First plea in law, alleging that the Commission’s failure to act was in breach of the obligation to set a time line pursuant to Article 15(2) of Regulation 2019/788 of the European Parliament and of the Council of 17 April 20191 and Article 41 of the Charter of Fundamental Rights. Second plea in law, alleging that the Commission’s refusal to grant the applicant access to the file in the „End the Cage“ matter constitutes an infringement of Article 41(2)(b) of the Charter...
